Conditions générales

The present document sets forth the Terms & Conditions related to the purchases of event services for individuals or groups provided by BrewSpot SPRL via the company website www.brewspot.com.local or sales team. Online purchase, quotation request and event organization request imply unconditional agreement with the The following Termes and Conditions which prevail above any external Term & Conditions.

Definition
“BrewSpot”: refers to the company BrewSpot SPRL, rue Arsène Matton 34, 1325 Dion-Valmont, Belgium and represented by Christophe Semaille and Jean-Christophe Larsimont.

“Event”: concerns all events for individuals, groups or corporations proposed by BrewSpot

“Prospect”: any individual or corporation that has contacted BrewSpot for an event proposal

“Client”: any individual or corporation that has purchased event services supplied by BrewSpot

Services description
The services provided by BrewSpot are described on www.brewspot.com.local and can be purchased directly online for standard recurrent events or either a first quotation phase with the company sales team for tailor- made events for groups.

BrewSpot will inform the Customer of any significant modifications planned for the purchased event with respect to the event description or quotation given to the Customer at the time of purchase. In case the modifications cause significant organizational changes to the Customer or significantly degrade or modify the event content, BrewSpot will propose compensatory measures.”

Online bookings
For all online bookings, the Customer receives a booking confirmation via his email address with all booking details.

An online booking for a Customer is only valid for one unique specific event on a specific date for a specified number of persons provided within the booking confirmation received by email.

An online booking can’t be transferred to another date and is not refundable (except under specific conditions set by the Belgian Law for online purchases).

Every participant has to show his booking confirmation to the BrewSpot animation team on the day of the event in order to be able to participate. If the confirmation is not presented, then the participant will be refused. In such circumstances, it will not be possible to transfer the booking to another date and the purchase will not be refunded.

Event vouchers
The vouchers allow to perform one or more online bookings on www.brewspot.com.local for events taking place during the validity period of the voucher. Once a voucher is used, the Customer will receive a booking confirmation via his email address with all booking details. No cancellation will be accepted after the voucher has been used.

The validity period of the event vouchers purchased on www.brewspot.com.local is mentioned on the purchased voucher. The voucher can’t be used outside the validity period and is not refundable in case the Customer is not able to attend one of the proposed event dates.

Every participant has to show his voucher to the BrewSpot animation team on the day of the chosen event in order to be able to participate. If the confirmation is not presented, then the participant will be refused. In such circumstances, it will not be possible to transfer the booking to another date and the purchase will not be refunded.

Tailor-made proposals
In case of tailored events for groups, the validity is mentioned in the related proposal made by BrewSpot and communicated to the Prospect. Beyond the validity date, the proposal is no longer valid and a proposal update has to be asked by the Prospect in case of further interest.

In case the proposal assumptions change during the validity period, BrewSpot will inform the Prospect immediately to identify potential solutions but will not be held responsible for these changes.

If the Prospect accepts the proposal set forth by BrewSpot then BrewSpot will check that all proposal assumptions are still valid and issue a contract that has to be signed between BrewSpot and the Prospect representative for final event confirmation. The event is confirmed and fully reserved only once the contract is signed between both parties.

After contract signature, the Customer falls under a strict cancellation policy:

– Cancellation one month or less before the event date will be charged 75% of the total event contractual price or up to the total expenses made by BrewSpot for the event if this exceeds 75% of the total event contractual price, provided that BrewSpot can provide evidence of such costs;

– Cancellations taking place 3 months to 1 month before the event date will be charged 50% of the total event contractual price or up to the total expenses made by BrewSpot for the event if this exceeds 50% of the total event contractual price, provided that BrewSpot can provide evidence of such costs;

– Cancellation within 3 months or more will be charged a 500EUR ex-VAT flat rate to cover the administrative costs or or up to the total expenses made by BrewSpot for the event, provided that BrewSpot can provide evidence of such costs;

After contract signature, the number of participants can be adapted within a +/- 20% range up to two weeks before the event date if possible and the pricing will be adapted accordingly. Below this delay of two weeks, it will not be possible to modify the number of participants and the price will be maintained accordingly even if the number of participants is reduced.

Publication of event pictures
All event participants accept to have publications of event pictures where they are present on the social media channels of BrewSpot. In case of groups, it is the responsibility of the group legal representative of the Customer to inform all participants of this clause. In case some participants do not want to have pictures of them published, they have to inform BrewSpot before the event by writing via email on contact@brewspot.com.local. In that case only will BrewSpot not publish pictures of these specific participants.

Intellectual property

All the material and content provided by BrewSpot before, during or after the event should be treated as the Intellectual Property of BrewSpot if not mentioned otherwise. By no mean this material can be transferred without the written approval of BrewSpot.

Responsibility
BrewSpot is only responsible for delivering the services and goods mentioned in the offer and cannot be held responsible for delivering anything that was not specifically mentioned in the offer.

BrewSpot is not responsible for price modifications operated by third-party companies and is free to adapt its pricing accordingly, as long as it provides the proof of these modifications.

BrewSpot cannot be held responsible for the failures of third-party companies, as long as it has transmitted the appropriate information.

Any damage caused by the participants can be charged to the company.

BrewSpot cannot be held responsible for the damages and injuries caused by improper handling of the beers produced or by not following properly the instructions provided during and after the workshop.

Force Majeure
Force Majeure of any kind, unforeseeable production, traffic/shipping disturbances, war/terrorism, fire/flood, unforeseeable shortages of labor, utilities or raw materials and supplies, strikes, lockouts, acts of government and any other hindrances beyond the control of BrewSpot shall relieve BrewSpot from its obligation.

Financial and cancellation policy
Pricing

For online purchases, the prices are mentioned including VAT and adapted to the number of participants.

The price mentioned in our event proposals are only valid for the number of participants specified. If the number of participants is reduced, the global budget of the activity will remain the same. If not mentioned otherwise, prices that appear in these offers should be considered as excluding VAT.

If not specifically mentioned, the price does not include shipping/delivery of the beers to the company. If requested by the company, these might be charged at 0.33€/km in Belgium and should be determined for companies outside of Belgium. BrewSpot is not responsible for damages occurring when the goods are under another company’s responsibility.

Any expense that is not included in the order will be included in the invoice made to the company. The company is responsible for the extra-expenses generated by its employees/partners/collaborators and should inform them accordingly. In case of disagreement about the extra-expenses claimed by a third party, the company will be responsible to prove them wrong or will pay for them.

If not mentioned otherwise, the invoice should be paid within 7 days following their emission. BrewSpot will charge 12% of the total invoice per month of delay.
